WHAT IS THE PROCESS FOR GETTING CUSTODY OF OR TIME WITH MY CHILDREN?


You and your spouse have separated and want to make arrangements for your children. Where do you start? Australian family law encourages parents to avoid going to court if possible. In fact, it is now compulsory for parents to try to resolve their parenting dispute with the help of a family dispute resolution practitioner (eg, a mediator or family counsellor). However, if there are allegations of child abuse or family violence, parents may be exempt from attempting family dispute resolution.

So what family dispute resolution options are available? Many parents are able to negotiate appropriate parenting arrangements with each other after they have consulted with an expert lawyer. However, some couples may require additional help, due to their emotional state or the family dynamics which exist at that time. Quite often they may use a mediator, a family counsellor, or engage a lawyer to negotiate with their former partner directly or their legal representative. Sometimes they may try more than one of these services.
